New Provisions on Ontario’s Payday Loan Act

One of Cities in Canada that allows payday loan lending businesses to operate is the city of Ontario. For several years many payday lenders have established themselves here. Pay Day loan lenders are required by law to follow the Payday Loan Act of Canada. The companies are legally obliged to follow this act with its recent changes. Below are the new provisions on the Ontario Payday Loan Act.

First provision on the four new provisions on the Ontario Payday Loan Act: Renewal or Acquiring of License.

The new set of laws requires that all the payday loan lenders and other loan brokers to be licensed. All payday loan lenders have to get licenses on or before the first of April.

Second provision on the four new provisions on the Ontario Payday Loan Act: No loan for a loan.

The new laws forbid the common term ‘rolling over of payday loans.’ This happens when a borrower borrows money from another lender or broker to pay off a previous payday loan. The city of Ontario is imposing a new system that tracks all the loans that are issued by the seven hundred fifty payday loan lending companies and brokers in Ontario.

Third provision of the four new provisions on the Ontario Payday Loan Act: Cool off period

Under the new laws on the Ontario Payday Loan Act a borrower should be allowed on what is known as a cooling off period. The cooling off period states that payday loan borrowers can choose to revoke their loans and they would not be charged with a penalty fee as long as they revoke it two days before they get the money.

Fourth provision on the four new provisions on the Ontario Payday Loan Act: Rate caps

The maximum total cost of borrowing that the Advisory Board of Ontario has advised of putting fees and interest caps on all payday loans of twenty one dollars for every hundred dollars. This effectively is setting the interest rate cap to twenty one percent. This also means that there is little charge if not none at all on defaulting on the payment of the payday loan.

This could be disastrous to payday lenders because it also sends the message telling people that defaulting on their payday loan payment is fine since the Ontario government actually supports it. Other people also think that not charging for late payments will somehow teach consumers in Ontario to borrow money in an irresponsible manner.
